OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN.  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

The Street Fest Instagram Giveaway (the “Giveaway”) is sponsored and administrated by Chartwells, a division of Compass Group USA, Inc., 2400 Yorkmont Road, Charlotte NC 28217 (“Sponsor”).  The Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram (“Instagram”). You understand that you are providing your information to the Sponsor and not to Instagram. Instagram is hereby completely released of all liability by each entrant in this Giveaway. Any questions, comments or complaints regarding the Giveaway must be directed to the Sponsor and not to Instagram. You may use only one (1) Instagram account (“Instagram Account”) to participate in this Giveaway.

Eligibility:

The Giveaway is open to legal residents of, and physically located within, any of the fifty (50) United States (including District of Columbia), who are at least eighteen (18) years of age or older as of entry, who is a student, faculty or employee at the higher education accounts where Sponsor is conducting its Street Fest event.

Agreement to Official Rules:

By entering, you indicate your full and unconditional agreement to (a) these Official Rules and (b) Sponsor’s decisions, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein, and any other reasonable requirement imposed by Sponsor.

Giveaway Period:

The Giveaway begins at 12:01 am Eastern Time (“ET”) on September 24, 2021 and ends on 11:59 pm (ET) on September 24, 2021 (the “Entry Period”). Sponsor’s computer is the official time-keeping device for the Giveaway.

How to Enter:

  • Via Instagram:

Upload a photo at any of Sponsor’s Street Fest events to your public Instagram account. Include @chartwellshighered and tag your campus dining page, and #festifulvibes in your main caption. You can enter only one photo per Instagram account. All entries become the property of the Sponsor.

  • Eligible entrants must have an Instagram account to enter. If you do not have an Instagram account, you may create one for free by visiting www.Instagram.com. By submitting your information and creating an account, you agree to the terms of use and privacy policy of Instagram. If you do not agree to such terms of use and privacy policy, you cannot create an account. Sponsor may not receive entries from Instagram users with “private” updates (i.e., Entrant has set his or her account so that only people the Entrant has approved can view his or her updates), so the account must be made “public.” If Entrant is using his or her mobile device to enter, charges, including message and data rates, may apply. Entrants should consult their wireless service provider regarding its pricing plans.

  • School attending or at which they are a faculty or employee.

Submission Requirements:

  • No entry may contain any offensive or vulgar content. Any entry containing inappropriate content, or that violate the terms and conditions set forth in these Rules, as determined by Sponsor in its sole and absolute discretion, will be considered ineligible and will not be part of the Giveaway. Automated entries, including entries submitted using any robot, script, macro or other automated service are not permitted and will be disqualified. Only eligible entries received before the end of the giveaway period will be included in the prize.
  • By participating in the Giveaway, each entrant hereby warrants and represents that any Post he/she submits:
    • is original to him/her;
    • does not violate any law, statute, ordinance or regulation; and
    • will not give rise to any claims whatsoever, including, without limitation, claims of infringement of any intellectual property rights, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party.

Odds of Winning:

The odds of winning a prize will depend on the number of eligible entries received.  On or about September 27, 2021, the Sponsor will randomly select one (1) potential finalist from the eligible entrants.

Notification and Requirements of Potential Winner:

The Sponsor will reach out directly to potential winners via direct message on Instagram or email on or about September 27, 2021, and such notification will direct the winner on how to redeem the prize.  Upon response from the potential winners, Sponsor may announce the winners via the @chartwellshighered Instagram account and campus dining page from the campus the person(s) won. If a potential winner does not respond and comply with the instructions in Sponsor’s initial direct message within two (2) days, he/she will forfeit the prize and Sponsor may award the prize to an alternate entrant. Only three (3) alternate entrants will be contacted. Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release.

Prizes:

The winner will receive a basket of joy with gift cards and swag.  ARV $500.

General Conditions:

In the event that the operation, security, or administration of the Giveaway is impaired in any way, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either: (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual who tampers with the operation of the Giveaway, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner. Sponsor reserves the right to seek damages from any person who seeks to undermine the legitimate operation of the Giveaway. Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail or email shall not be deemed proof of receipt of that communication by Sponsor. In the event of a dispute as to the owner of an entry, the authorized account holder of the Instagram or email account used to enter will be deemed to be the entrant.

By accepting any prize, each entrant consents to the use of their names, voices, and likenesses, including photos and videos and all accompanying personally identifiable information entrant submits or Sponsor obtains in the course of entrant accepting any prize, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation (other than the specific prizes described herein) to entrant, his/her successors or assigns, or any other entity, except where prohibited by law.

Use Rights:

By participating, you: (a) irrevocably grant Sponsor, its agents, licensees, and assigns the unconditional and perpetual (non-exclusive) right and permission to publish, post, and display, your photo as-is or as-edited (with your name or Instagram handle included to indicate photography credit) on its social media feeds and blog without approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Sponsor’s use of your photo as outlined above, or require any further permission for Sponsor to use the photo; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor on the grounds that any use of the photo, or any derivative works, infringes any of your rights as creator of the photo, including, without limitation, copyrights, trademark rights, and moral rights.

Entrant authorizes Sponsor to collect, use, process, transfer and store all data provided by entrant, including without limitation, personal data, to the United States, or any location(s) throughout the world that Sponsor deems necessary, whether within entrant’s country of residence or elsewhere, and with such party(ies) as Sponsor deems appropriate, for purposes of administration of the Giveaway.  All information submitted to Sponsor as part of this Giveaway will be treated in accordance with Sponsor’s privacy statement, available at https://www.compass-usa.com/privacy/.  Personal information will be used only to: (a) enter the Giveaway and provide information about the Giveaway; and/or (b) contact and publicize potential winners.  Entrants have the right to withdraw and correct their personal data, or opt-out of the Giveaway, by contacting the Sponsor in writing at 2 International Drive, Rye Brook, NY  10573 c/o Amy Russo, attention: #Street Fest Instagram Giveaway Entry.

Release and Limitations of Liability: By participating in the Giveaway, you agree to release and hold harmless Sponsor, Instagram, its parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway including, without limitation, any unlawful “hacking” or access by outside third parties attempting to access participants’ data and information or otherwise breaching Sponsor’s security systems; (b) technical errors related to computers, servers, providers, or telephone, or network lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (c) any errors on the Instagram platform that may prevent an entrant from entering or receiving direct messages; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) any other errors or problems in connection with the Giveaway, including, without limitation, errors that may occur in the administration of the Giveaway, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, or text messages, or in any Giveaway-related materials; (g) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use of any prize; or (h) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, defamation or invasion of privacy and merchandise delivery. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages, and any and all rights to have damages multiplied or otherwise increased.

Disputes:

The Giveaway and these Official Rules will be governed, construed and interpreted under the laws of the State of North Carolina without regard to choice of law principles.  Entrants specifically agree that any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of North Carolina, or the appropriate North Carolina Court located in Charlotte, North Carolina.

To request a winners’ list, email Sponsor at Janelle.craft@compass-usa.com, with the subject line “List of Winners –2021 Chartwells Street Fest Instagram Giveaway”.  Requests must be received within four (4) weeks after the end of the Giveaway Period.
